International Family Law and Child Protection


I am a Spanish family lawyer with residence in the Costa del Sol, specialized in international family law and child protection. My practice is mainly focused in advising clients on all issues arising from the breakdown of a relationship including divorce, financial settlements, disputes relating to children, pre-nuptial and post-nuptial agreements, cohabitation agreements, and disputes.

I am particularly trained and experienced in dealing with cases involving different jurisdictions, due to the national law of the spouses and the residence of the family, and the advise and assistance in litigation before the Spanish Courts in divorce proceedings of high net worth international clients. I am also particularly involved in advising clients on international children’s issues including international relocation, custody, residency, visiting rights and child abduction matters.

I am fluent in Spanish and English, and I am proud to have an intense collaboration with relevant international law firms (in U.K, Sweden and Germany, among other countries), which allows me to provide services to a wide range of foreign individuals with residence in Spain. My professional goal is to provide my foreign clients with a personal and direct but also internationally opened legal advice when experiencing relationship breakdowns. Despite my experience in litigation before the Courts, I do recognize the benefits of alternative dispute resolution and try to provide practical and common sense advice to my clients in order to avoid costly litigation where possible.

Based on these principles, and in order to provide my clients with a better service, I have founded Mayte Garcia International Family Law, S.L.P., a Law Firm that comprises a group or highly experienced and qualified lawyers specialized on all aspects of Family Law from an international perspective.


Legal defense of several high-net-worth divorce cases of foreign clients (U.K., Denmark, and Sweden) with their family residence in Marbella, including both the financial aspects and matters related to children´s custody in coordination with top-ranked international law firms.

Acting as an independent expert on Spanish disability law at the request of the Court of Protection (U.K.)

Advising in the preparation of pre-nuptial and post-nuptial agreements in conjunction with overseas lawyers and other advisers.

Continued advice to Swedish citizens residing in Spain about their family matters, children´s custody and disability matters, taking into consideration the regulations and benefits available in both jurisdictions.

Assisting the client in the negotiations of the financial agreements for the distribution of the assets owned by the divorcing couple, including a relevant business.

Representing an Irish mother in a child abduction case in Spain.
